These Terms of Service constitute a legally binding agreement between you and CyberGuard Academy regarding your participation in our cybersecurity training programs and use of our educational services. By enrolling in any course, accessing our training platforms, or participating in our programs, you acknowledge that you have read, understood, and agree to be bound by these terms.

These terms apply to all students, prospective students, and users of our services, including but not limited to training participants, website visitors, and individuals accessing our educational content. Your continued use of our services constitutes ongoing acceptance of these terms and any modifications we may make.

We reserve the right to modify these terms at any time to reflect changes in our services, legal requirements, or business practices. We will notify you of significant changes through our platform or other communication channels. Your continued participation after such modifications constitutes acceptance of the updated terms.

Service Usage and Availability

Training Program Access

Course Enrollment: Access to cybersecurity training programs is granted upon successful enrollment and payment verification. Course materials, lab environments, and instructor support are available according to the specific program schedule.

Platform Availability: We strive to maintain 99.5% uptime for our educational platforms, though occasional maintenance windows and technical issues may temporarily restrict access. Students will be notified in advance of planned maintenance whenever possible.

Content Updates: Training materials and curriculum content may be updated periodically to reflect current cybersecurity trends, threats, and industry best practices. Students will have access to updated materials during their enrollment period.

Lab Environment Access: Virtual lab environments are provided for hands-on training and must be used solely for educational purposes. Lab access is limited to enrolled students and expires upon course completion unless extended through additional agreements.

Account Terms and Conditions

Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized access or security breaches.

Accurate Information: You must provide accurate, current, and complete information during enrollment and maintain the accuracy of your account information throughout your participation in our programs.

Single User Access: Each account is for individual use only. Sharing account credentials or allowing unauthorized access to your account is strictly prohibited and may result in account suspension.

Account Termination: We reserve the right to suspend or terminate accounts that violate these terms, engage in fraudulent activity, or disrupt the learning environment for other students.

Service Limitations and Modifications

Course Modifications: We reserve the right to modify course content, schedules, instructors, or delivery methods to maintain educational quality and relevance. Students will be notified of significant changes that may affect their learning experience.

Enrollment Limits: Class sizes may be limited to ensure quality instruction and adequate attention to each student. Enrollment is processed on a first-come, first-served basis unless otherwise specified.

Technical Requirements: Students are responsible for meeting minimum technical requirements for platform access and lab participation. We provide guidance on system requirements but cannot guarantee compatibility with all devices or configurations.

Service Interruptions: While we strive for continuous service availability, we cannot guarantee uninterrupted access due to factors beyond our control, including internet outages, hardware failures, or cyber security incidents.

User Responsibilities and Conduct

Acceptable Use Policy

You agree to use our services only for legitimate cybersecurity education and career development purposes. All training activities must comply with applicable laws and ethical guidelines for cybersecurity professionals.

  • Use lab environments only for assigned educational exercises and authorized experimentation

  • Maintain professional conduct in all interactions with instructors and fellow students

Prohibited Activities

The following activities are strictly prohibited and may result in immediate account suspension or termination, as well as potential legal action.

  • Using acquired skills or knowledge for malicious, illegal, or unauthorized activities
  • Attempting to access systems, networks, or data without explicit authorization
  • Sharing, distributing, or selling proprietary course materials or lab exercises
  • Disrupting the learning environment or harassing other students or staff
  • Using our platforms to distribute malware, viruses, or other harmful code
  • Attempting to circumvent security measures of our training platforms

Academic Integrity Requirements

As a cybersecurity professional in training, you are expected to demonstrate the highest standards of academic integrity and ethical behavior throughout your participation in our programs.

  • Complete all assignments and assessments using your own knowledge and skills
  • Cite sources appropriately when referencing external materials or research
  • Report suspected violations of academic integrity policies
  • Participate honestly in all testing and certification processes
  • Maintain confidentiality of assessment content and lab scenarios

Legal Information and Dispute Resolution

Limitation of Liability

Educational Services: Our training programs are designed to provide cybersecurity education and skill development. We do not guarantee specific career outcomes, salary increases, or job placement results, though we provide career support and guidance.

Technical Issues: We are not liable for damages resulting from technical difficulties, platform outages, or compatibility issues that may affect your access to training materials or lab environments.

Third-Party Content: We may reference or link to third-party resources, tools, or platforms for educational purposes. We are not responsible for the availability, accuracy, or content of external resources.

Maximum Liability: Our total liability for any claims related to our services shall not exceed the amount you paid for the specific program or service giving rise to the claim.

Disclaimer of Warranties

Service Quality: While we strive to provide high-quality cybersecurity education, our services are provided "as is" without warranties of any kind, express or implied, including warranties of merchantability or fitness for a particular purpose.

Educational Outcomes: We cannot guarantee that completion of our training programs will result in specific certifications, job opportunities, or career advancement, as these outcomes depend on many factors beyond our control.

Continuous Access: We do not warrant uninterrupted or error-free access to our platforms, though we make reasonable efforts to maintain service availability and quality.

Governing Law and Jurisdiction

Applicable Law: These terms and your relationship with CyberGuard Academy are governed by the laws of Sri Lanka, without regard to conflict of law principles.

Jurisdiction: Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts of Sri Lanka.

International Students: Students from other jurisdictions acknowledge that Sri Lankan law applies to their participation in our programs, while maintaining their rights under applicable consumer protection laws.

Dispute Resolution Procedures

Direct Communication: We encourage resolving any concerns or disputes through direct communication with our student support team before pursuing formal legal action.

Mediation Process: If direct communication does not resolve the issue, we are willing to participate in mediation through a mutually agreed-upon mediator to reach a fair resolution.

Arbitration Option: For significant disputes, parties may agree to binding arbitration as an alternative to court proceedings, following established arbitration rules and procedures.

Legal Action: Any legal proceedings must be initiated within one year of the incident giving rise to the claim, and parties agree to seek resolution through appropriate Sri Lankan courts.
